<p>DeStefano and his family arrived in the US around 1909 and tragedy soon struck when his father, Giuseppe DeStefano, an accomplished violin maestro died in a trolley accident. Alone in a foreign country, his mother was left with no means of support.</p>

<p><strong><span class="font-size-3">Fearing for her two children's well-being a matchmaking neighbor - the mother of mobster Frank Costello - found her a new husband</span></strong>. She married a man named Galata and died shortly thereafter, leaving her two children at the mercy of the stepfather, who despised the young Jimmy. Continual abuse forced DeStefano into the streets where he joined his friends and began a colorful criminal career that would eventually lead him to Sing Sing Prison. There, for five years, as the death house barber, he gave 46 men and one woman their final haircut.</p>
<p> </p>
<p>"I never grew used to the job," he confessed in a six-part 1934 series run by the New York Journal. "Each execution was an ordeal."</p>
<p> </p>
<p>Al Capone and Jimmy were working as bouncers at the Harvard Inn, where Capone got the infamous scar on his face. Their common desires to escape the stench of poverty and get their piece of the American dream bonded them for life. While working in the Harvard Inn DeStefano and Capone came into contact with an up-and-coming mobster by the name of Johnny Torrio. They admired Torrio's quick mind and looked to him as their mentor. "The Shiv" later became acquainted with Alessandro Vollero who served as a mentor to both him and Joseph Valachi.</p>
<p> </p>
<p>Jimmy's many daring escapades with Frank Costello, Bugsy Siegel, Meyer Lansky and Lucky Luciano molded his future.</p>
<p> </p>
<p>Lewis E. Lawes, Warden of Sing Sing Prison for 21 years met Jimmy as a young boy in the Protectory where Jimmy had already acquired the moniker "The Shiv" defending himself from the advances of a priest. Warden Lawes recognized his desperate situation and they became friends as he supported and encouraged the troubled boy. While confined in the Protectory in Brooklyn, he also became friends with Joe Valachi and Jacob Shapiro.</p>
<p> </p>
<p>In 1918, mobster Frankie Yale contacted Torrio and requested that he take Al Capone and Jimmy "The Shiv" to Chicago; they were both in trouble and facing prison time. DeStefano however, was eventually caught and landed in Sing Sing for the first time in 1918.</p>
<p> </p>
<p>While imprisoned in Sing Sing he also came into contact with a violent young mobster who was on death row but would later have his sentenced overturned, Albert Anastasia, who would later become a powerful and notorious mob boss. The Barber (Jimmy) told his friend Lucky Luciano that he needed someone like Albert Anastasia. Luciano managed to have a re-trial for Anastasia and killed many witnesses for Anastasia and a judge set Anastasia free.</p>
<p> </p>
<p>After his release, DeStefano returned to a life of crime and was sent back to Sing Sing in 1927. In 1936, while out of prison, Jimmy reported to a New York City parole officer, who disliked him and the men he was connected to. Abusing his powerful position (and wanting to teach him a lesson) he beat him so severely that it nearly took his life. He, an innocent man, was shipped back to Sing Sing with bogus documents prepared by the parole officer. From there, after fourteen months with Warden Lawes's encouragement he represented himself before the New</p>

<p>York Supreme Court, successfully winning his appeal and his freedom. He emerged from the prison shadows to marry his sweetheart, Maria Durante, the niece of famous entertainer Jimmy Durante, and lead an exemplary life.</p>

<div>In 1759, when only eight years old, he inherited his father's throne in Napoli, who had to a<em>bd</em>icate when he himself inherited the crown of Spain after ruling in Napoli since 1734, to which he had been elevated as the grandson of French King Louis XIV (again, the politics are mind boggling) after 27 years of Austrian Hapbsburg rule. Before that, Napoli had been part of the Spanish Empire for two centuries. </div>

<div>Therefore, the founding decree was really the legal decision of the Regency Council in Napoli, which effectively had to answer to Ferdinand's father, King Carlo in Spain. The Council, in turn, was dominated by the Prime Minister, a favorite of King Carlo. He was a <em>marchese,</em> named Bernardo Tanucci. Many contemporaries (among them the English ambassador Lord Hamilton, who later became famous as the cuckolded husband of Admiral Nelson's mistress) characterized him as absolutely incorruptible, devoted to the welfare of the people, but stern and grumpy. It would be interesting to know how he got along with the powerful Serra family.</div>

<div>I also found out that that Admiral Pallavicini commanded the Neapolitan navy in 1734, which may explain the cryptic note thatGiovan Francesco Serra (who died fighting the Turks at sea in 1656) purchased the feudal rights to Cassano in 1628 "through the agency of Antonio Pallavacini," possibly, on speculation, as a reward for the Serra's military service.</div>

<div>One year after the founding of Lauropoli there was a "great famine," followed the next year by an epidemic, both catastrophes perhaps influencing the decision of the founding families to relocate.</div>

<div>Tannuci was responsible for Ferdinando's first act upon coming to age, the expulsion of the Jesuits, which order taught at my high school.</div>

Presumably Gennaro went with her and resented the monarchy. The Duchess of Cassano spent a year in Paris, sending her sons to be educated there, probably a source of Gennaro's republican views.</div>

<div>During the Calabrese Uprising of 1799 the author implies that Cassano, along with most of Calabria, yielded to Cardinal Ruffo. Gennaro, who was beheaded, was Second in Command of the pro-French Parthenopean National Guard. I had wondered who was the Top Commander and why he was not also executed. This book names him as the Swiss mercenary General Wirtz, who was killed in battle.</div>

<div>The Battle of Marengo in 1801 caused the restored Queen Carolina to tone down her persecution of the defeated rebels, so the Serras probably returned at that time. The French army occupied border areas of the Kingdom but did not physically occupy the city until 1806. Cosenza went over to the French side. There is a confusing account of a battle or skirmish at Cassano.</div>

<p><ins>The complaint in the action was filed on October 22, 1952. The papers submitted on this motion show that at the time of the commencement of this action, an affidavit of good cause dated September 25, 1952, sworn to by Maurice A. Roberts, an attorney of the Immigration and Naturalization Service, United States Department of Justice, was in the possession of the United States Attorney for this District. It furthermore appears that this affidavit was filed in this Court on November 17, 1955. A copy of the affidavit has been presented upon the motion.</ins></p>
<p><ins>While it is a prerequisite to the institution of a proceeding of this nature that an affidavit of good cause be in the possession of the United States Attorney <a href="http://ny.findacase.com/research/wfrmDocViewer.aspx/xq/fac.19551209_0000247.SNY.htm/qx#D610510002-opinionfn2">*fn2</a>" and it had been held that it is a requirement that such affidavit be filed, <a href="http://ny.findacase.com/research/wfrmDocViewer.aspx/xq/fac.19551209_0000247.SNY.htm/qx#D610510002-opinionfn3">*fn3</a>" it is not a prerequisite that that affidavit be filed at the time the action is instituted. Thus, in the Zucca case, the Court simply directed that the action for denaturalization be dismissed unless the government filed the affidavit of good cause within fifteen days. See also United States v. Candela, D.C.S.D.N.Y.1954, 131 F.Supp. 249 where the Court denied the application to dismiss the proceeding but directed that the government, within ten days, should file the affidavit of good cause.</ins></p>
<p><ins>An affidavit of good cause has been filed in this case and the defendant has not been prejudiced by the delay in filing it. There is no requirement in the law that the affidavit of good cause must be filed at the time of filing the complaint. If the affidavit is filed in such time that the defendant can test its sufficiency, no prejudice results in this later filing of the affidavit.</ins></p>
<p><ins>The defendant in this motion now seeks to test the sufficiency of the affidavit of good cause on file in this action. The attack upon the sufficiency of the affidavit is made upon the basis that Maurice A. Roberts, who made the affidavit, had no personal knowledge of the facts stated in the affidavit and made his allegations solely upon the basis of 'the official records' of the Immigration and Naturalization Service. The affidavit states such facts as would, if supported by evidence, appear to afford legal grounds for the cancellation of the naturalization of the defendant. An affidavit of good cause in such a proceeding is not a pleading. Its sole purpose is to furnish an authentic source through which the United States Attorney may receive information, upon which he may rely, of a violation of the statute. Not being a pleading, the affidavit need not state its contents with exactitude, but it is sufficient that the substantive matter required be presented, no matter how informally or inartificially stated. United States v. Leles, D.C.N.D.Cal.1915, 227 F. 189. Nor is the fact that the affidavit is not made on personal knowledge but merely represents a summary of matters which the affiant found in the files of the Immigration and Naturalization Service a ground for questioning the sufficiency of the affidavit. United States v. Chandler, D.C.D.Md.1955, 132 F.Supp. 650; United States v. Leles, supra.</ins></p>
<p><ins>The motion to dismiss is denied.</ins></p>

<p><ins>This is an action to denaturalize defendant. He moves to dismiss it on two grounds: (1) failure of the Government to file, at the time of filing the complaint, the affidavit of good cause required by section 1451(a) of title 8 United States Code; and (2) insufficiency of an affidavit of good cause filed more than three years after the filing of the complaint.</ins></p>
<p><ins>The complaint was filed on October 22, 1952. The affidavit of good cause, though verified on September 25, 1952, was not filed until November 17, 1955.</ins></p>
<p><ins>A motion previously made by defendant to dismiss this complaint on these same two grounds was denied by Judge Dawson in a memorandum dated December 9, 1955. D.C., 142 F.Supp. 325. The motion has been renewed to determine whether a different decision is required by the recent Supreme Court opinion in United States v. Zucca, 1956, 76 S. Ct. 671, 677. It is conceded by both parties that, at the very least, that case held that an affidavit of good cause must be filed in denaturalization proceedings.</ins></p>
<p><ins>Defendant contends that the Zucca case holds that the filing of an affidavit of good cause is an essential condition to jurisdiction. If this interpretation is correct, a later filing of an affidavit would not cure the defect, for jurisdiction would never have been obtained. In support of this interpretation defendant points to the closing paragraph of the court's opinion, where it is stated that</ins></p>
<p><ins>'We believe that, not only in some cases but in all cases, the District Attorney must, as a prerequisite to the initiation of such proceedings, file an affidavit showing good cause.'</ins></p>
<p><ins>The question is thus presented whether the Supreme Court meant that filing was a jurisdictional prerequisite or merely a procedural prerequisite. Reconstruction Finance Corp. v. Prudence Securities Advisory Group, 311 U.S. 579, 61 S. Ct. 331, 85 L. Ed. 364. I can find nothing in the opinion which would indicate that the Supreme Court regarded the requirement as jurisdictional. There is no suggestion that a denaturalization order would be void if the affidavit had not been filed with the complaint. There is no suggestion that a court could not, upon proper terms, permit the late filing of the affidavit in a pending proceeding. On the other hand, in five places in the opinion, the word 'procedural' is applied to the requirement.</ins></p>
<p><ins>Defendant's motion to dismiss the complaint because of late filing of the affidavit of good cause must therefore be denied.</ins></p>
<p><ins>The second ground for dismissal propounded by defendant is that of insufficiency of the affidavit of good cause.</ins></p>
<p><ins>Defendant contends that the Zucca opinion requires that the affidavit set forth evidentiary facts and be executed by one who has personal knowledge of those facts. Defendant refers to the statement in the majority opinion that</ins></p>
<p><ins>'the affidavit must set forth evidentiary matters showing good cause for cancellation of citizenship.'</ins></p>
<p><ins>The dissent interpreted that statement, as does this defendant, to mean that</ins></p>
<p><ins>"the Government must furnish the Court with sworn statements by persons having personal knowledge of the facts".</ins></p>
<p><ins>I disagree with this view that an affidavit made up of hearsay is insufficient. The Supreme Court met the argument that the complaint took the place of the affidavit by saying 'The complaint, under modern practice, is required merely to allege ultimate facts while the affidavit must set forth evidentiary matters showing good cause for cancellation of citizenship.' The court thus contrasts 'evidentiary matters' with 'ultimate facts', not with 'hearsay'. The statute in requiring the affidavit in addition to the complaint seeks to accomplish the same end that is served by the familiar requirements that affidavits in support of a complaint be furnished where provisional remedies like attachments and preliminary restraining orders are sought. The purpose is to give the concrete facts behind the charge as distinguished from its abstract theory. The defendant's property should not be seized or his freedom of action curtailed on the mere statement of a theory. I believe that the Supreme Court referred to this principle when it said in the Zucca case: 'The mere filing of a proceeding for denaturalization results in serious consequences to a defendant. Even if his citizenship is not cancelled, his reputation is tarnished and his standing in the community damaged. Congress recognized this danger and provided that a person, once admitted to American citizenship, should not be subject to legal proceedings to defend his citizenship without a preliminary showing of good cause.' This protection is afforded if concrete details rather than 'ultimate facts' are set forth in the affidavit. There is little likelihood of injustice if details are given and they are verified by oath. An additional requirement of personal knowledge on the part of the affiant would add so little that such increase of protection as it would afford would be outweighed by its unwieldiness.</ins></p>
<p><ins>Plaintiff here insists that its affidavit of good cause meets the test of the Zucca opinion in that it sets forth sufficient evidentiary facts. The affidavit was executed by Mr. Maurice A. Roberts, an attorney for the Immigration and Naturalization Service. Mr. Roberts has no personal knowledge of the facts alleged in the affidavit; he obtained the information from the official files of the Immigration Service.</ins></p>
<p><ins>The affidavit contains sufficient evidentiary facts to support charges in the complaint which, if true, would justify defendant's denaturalization. For example, it sets forth allegations made by defendant in his naturalization proceedings and then proceeds in subparagraph (c) as follows:</ins></p>
<p><ins>'(c) That all of the allegations of said Frank Costello and his said witnesses, as set forth in the preceding subparagraph, were false and untrue as more particularly appears hereinafter.</ins></p>
<p><ins>'(I) The said Frank Costello had assumed and used the name Frank Saverio, and under that name had been convicted on March 12, 1915 of carrying a concealed and deadly weapon and had been sentenced to sefve one year in the penitentiary.</ins></p>
<p><ins>'(II) The said Frank Costello had in addition been arrested for crime on May 8, 1908 and October 19, 1912.</ins></p>
<p><ins>'(III) On May 1, 1925, and during the preceding five years, the said Frank Costello's principal occupation was gambling and illicit traffic in liquor in violation of the 18th Amendment to the Constitution and of the laws of the United States and the several states.</ins></p>
<p><ins>'(IV) During the period from May 1, 1920 to September 10, 1925, the said Frank Costello failed to file Federal and State income tax returns and failed to pay Federal and State income taxes, although he knew he was liable therefor.</ins></p>
<p><ins>'(V) During the period from May 1, 1920 to September 10, 1925, the said Frank Costello was not attached to the principles of the Constitution of the United States.</ins></p>
<p><ins>'(VI) When he took the oath of allegiance, the said Frank Costello did not intent to support and defend the Constitution and laws of the United States and bear true faith and allegiance to the same, but on the contrary intended to continue in the illicit traffic in liquor in violation of the Constitution and laws of the United States.</ins></p>
<p><ins>'(VII) The two witnesses who executed the affidavits and testified in support of the naturalization petition of the said Frank Costello were not credible witnesses. Each witness was then engaged, as his principal occupation, in the illicit traffic in liquor in concert with the said Frank Costello. Each witness then knew that the said Frank Costello had not been and was not then a person of good moral character, attached to the principles of the Constitution of the United States or well disposed to the good order and happiness of the United States. Each witness then knew that the said Frank Costello had not behaved as a person of good moral character and that the said Frank Costello was not qualified to be admitted a citizen of the United States.'</ins></p>
<p><ins>All of those allegations are sufficiently concrete and detailed except those which deal with the state of mind of defendant and his witnesses. There circumstantial evidence to substantiate the conclusions as to state of mind should have been alleged.</ins></p>
<p><ins>I have said enough to demonstrate that the complaint should not be dismissed for insufficiency of the affidavit of good cause. The question whether allegations in the affidavit should be stricken as making charges against defendant unsupported by evidentiary details is not before me. Nor is the question whether evidence in support of such allegations should be admitted on the trial.</ins></p>
<p><ins>Motion denied.</ins></p>
